Back to the plot...

In UK law (I did a little research to confirm what I thought was the case):
EBGames would be criminally liable for handling stolen goods if they were reckless in their purchase:
"Recklessness may include not making sufficient enquiry if goods are offered in suspicious circumstances." (Quoted from a random website that claims to be quoting the law).

They would certainly be liable under Civil law:
"Purchasers, including those who purchase in good faith from a legitimate dealer, may be sued in English law at the County Court for damages by the original owner, even if they have sold the property to someone else."

Obviously it's not the same in the States.
Can anyone just get away with selling stolen goods if they claim they didn't know it was stolen?
So the original owner has no leg to stand on?

Personally, I think that the way EB has reacted to this, is nothing short of scandelous. Even if they weren't obliged by law to return or re-imburse her property, it would only be good customer relations for them to do so. Would be good publicity for them, too.

Verno is correct in saying that if this happened in the UK, in the eyese of the law, EB would be liable for selling stolen goods (regardless of whether EB even knew if they were stolen or not).

I'm assuming that Michelle did not have her items insured? My own home was broken into last November and I had my PS2, games and around 150 movie DVDs stolen, but I was fortunate enough to have insurance cover and got my stuff back through them.

I hope her luck changes for the better soon

I think the big mistake here was that she went to handle the situation herself. She should have contacted EBGames' district management and/or corporate *Before* she tried to retreive the items in person.

Small retail outlets like EB generally don't have store-level authorization to give away hundreds of dollars in equipment, even with a police report saying that the purchase of the items was not legitimate. Quite honestly, if I'd been in that manager's position, I would have done the exact same thing. I don't care how screwed up the situation is, it wouldn't be worth my job.

Sadly....the best way she could handle this is to sue the holy hell out of EB.


We all know she'd win...and get well over the cost of the system, etc. in settlement (for mental hardship, of course!).

It's sad (see above), because I think the way our legal system works on issues like this isn't exactly sound..but EB is playing the part of the jackass here, and definately deserves to get singed a bit.



That or firebomb the mall /shrug.

Coincidentally my 8 year old niece the other day was explaining to me that the moon and stars are always there, you just can't always see them. Of course, I knew that, but it's good to know that even 8 year olds know that....

I wonder if the police were involved in this process in any way other than the burglary. In CA, if you purchase stolen property without a proof of purchase from the seller, you must return the goods to the owner when the police get involved. And then there's the waiting period.

What should have happened is this: Michelle reports the location of her goods to the cops. The cops go to the store and retrieve the goods. If any of the goods had already been stolen within the waiting period, the store must make restitution. The store then makes a claim on its insurance and gets its money back.
