GIE Media, a Cleveland company that runs the online pest-control portal PCT Online, is suing an Arkansas man who the company says is constantly leaving obnoxious and offensive messages on its Internet bulletin board and then, after he is banned from the site, sneaking back using fake names.
ROFL!

GIE is alleging trespassing, breach of contract and violations of the Computer Fraud and Abuse Act. It is seeking at least $5,000 from Huckaby. The company also wants the judge to bar him from visiting PCT Online.
Ok, that's not funny anymore....

this isn't a case about free speech but about honoring the contracts - those long terms-of-use agreements most users click through - that users accept before they use an Internet service.
That is most definatly not funny, the outcome of this case could have some sever implications on internet usage in general. as of yet, at least as far as I know, no EULA has been found to be a leagly binding contract. if this case sets it up as one, that could then mean that they all are. To actualy have ALL of that non negotiable leagle crap be leagly binding instead of just a cover your ass method is insane, and definaly not worth 5 grand from some retarded ass hole that likes to flame a pesticide message board fourm.

if I am incorrect in that assesment, please inform me.

I think you'll find that Myth's EULA was found legally binding when a judge threw some company out who tried to sue for loss of earnings when their characters which they used for selling items for real life money were deleted and banned.

I think it's high time we did start honoring these agreements. People here are banned everday for violating EM board rules.
